Terms and Conditions, Cancellations and Refund Policies

If a tour is through a third party, their refund policy will be followed, check booking page for details. (refer item #3 Cancellation by Supplier)

No refunds for failure to attend or complete the retreat. Non-refundable deposits for a Her Luxe Travel operated tour/retreat (not a third party tour) are transferable to another Her Luxe Travel retreat or tour. Follow operator policies if they cancel for any reason.

b.    Cancellation by Us

We reserve the right to cancel if safety is compromised due to weather, operational requirements, or failure to meet minimum tour numbers.

Full deposit refund if minimum numbers are not reached by a set date. We need to reach MINIMUM NUMBERS for each tour; a cut-off date will be imposed. If this is not reached, we have the right to cancel the tour or retreat.

We will retain your deposit until minimum tour numbers have been reached, if we do not get minimum numbers by a set date, your full deposit will be refunded. We will notify you via email if the minimum confirmed numbers have not been completed.

Her Luxe Travel will not be liable for any consequential losses or additional costs incurred as a result of cancellation.

We may cancel a trip at any time up to one calendar month before departure. If we cancel your trip, other than due to a Force Majeure event as described below, you can receive a one-time transfer credit for all amounts paid to an alternate departure date or to another tour or retreat. We may cancel a trip at any time prior to departure if, due to terrorism, natural disasters, political instability, or other external events it is not viable for us to operate the planned itinerary. If we cancel your trip, you can transfer the amounts paid to an alternate departure date or alternatively receive a full refund, less the non-refundable deposit.  In circumstances where the cancellation is due to external events outside our reasonable control refunds will be less than any unrecoverable costs. We are not responsible for any incidental expenses that you may have incurred as a result of your booking, including but not limited to visas, vaccinations, travel insurance excess, or non-refundable flights.

c.    Cancellation by Supplier

Suppliers’ cancellation policies apply. We will assist in obtaining applicable refunds per supplier terms. Supplier-provided refunds or credits are not Her Luxe Travel’s responsibility.

We will inform you as soon as reasonably possible if a supplier needs to make a significant change to your confirmed booking or to cancel. We will also mediate between you and the supplier in relation to any alternative arrangements offered by the supplier, but we will have no further liability to you.

Her Luxe Travel incurs costs with the suppliers of your tour or retreats well in advance of your tour date. All suppliers have their own cancellation policies, which apply to your booking.  Upon receipt of your cancellation request, we will contact the suppliers for any applicable refunds subject to the supplier’s terms and conditions.  If you are entitled to a refund, please note that the supplier is responsible for this refund, not Her Luxe Travel. Suppliers may choose to provide a travel voucher or credit in lieu of a refund.  We are not responsible for a supplier’s failure to pay a refund or for supplier bankruptcy or insolvency.

*Please note, we follow the terms and conditions of the operators we work with. If they deem to cancel for any reason their policy will be followed.

Confirmed Reservations & Payments

1.   Deposit & Booking Confirmation

A non-refundable 30% deposit confirms your booking and establishes a contract between us.

All payments are to be made in New Zealand dollars and must include payment for any bank charges incurred. All retail prices are in $NZD. Prices are subject to change without notice.

If you have made payment by Credit Card, the name that will appear on your statement will be Her Luxe Travel.

Please note that there may be a levy of up to 4% applied to all purchases made by credit card.

All bookings must be used in accordance with the applicable dates and any conditions printed on them and with any other applicable terms and conditions.

Payment of a deposit forms part of the final payment and means you have read and accepted these Terms and Conditions of Sale.

2.   Final Balance Payments

Refer to your booking confirmation for specific deadlines.

Failure to pay in full by the deadline may result in cancellation.

3.   Credits and Covid credits

Please note that Covid-19 terms and conditions apply. In case of pandemic restrictions, a 100% travel credit will be provided for any balance paid, which can be used for future tours or retreats. Please be aware that there will be no refunds in case you fail to attend or complete the retreat or tour. Please secure travel insurance at the time of your booking.

Any non-refundable deposit is a transferable credit to another retreat or tour for Her Luxe Travel.

Exclusions

The price of your trip with us does not include the following, nor anything else not specifically stated as included in the itinerary:

· international or domestic flights unless specified

· airport transfers, taxes, and excess baggage charges unless specified

· meals and beverages other than those specified in the Trip Notes

· visa and passport fees

· travel insurance

· optional activities and all personal expenses

· gratuities

Important: Travel insurance is mandatory for all our tours and retreats. We advise you to take out travel insurance as soon as your booking is confirmed and make sure it has a cancellation clause at the time of booking which will cover any cancellation fees. If you fail to join a tour, join it after departure, or leave it before its completion, no refund will be made.

Passport and visas

You must carry a valid passport and have obtained all of the appropriate visas, permits, and certificates for the countries in which you will visit during your trip. Your passport must be valid for 6 months beyond the end date for the trip. It is your responsibility to ensure that you are in possession of the correct visas, permits, and certificates for your trip; please refer to the Trip Notes for details. We are not responsible if you are refused entry to a country because you lack the correct passport, visa, or other travel documentation.

Our Flexibility

We aim to be flexible, so you appreciate and acknowledge that the nature of this type of travel requires considerable flexibility, and you should allow for alternatives. The itinerary provided for each trip is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities, and mode of transport may be subject to alteration without prior notice due to local circumstances or events.

Your details to us

Prior to your booking, you will be sent a traveller profile, we ask that you fill this out and return, so we can accommodate you as best we can. We accept no responsibility if you fail to do this. We accept no responsibility for any personal injury or death, and travel insurance is mandatory, and it is up to your discretion that your insurance provider will cover you for all your travel requirements; please read and check your policy to make sure you are properly covered.

You must provide us with all requested details and have paid the balance of the trip price no less than two months prior to commencement. Necessary details include full name as per passport, date of birth, nationality, passport number, passport issue, and expiry date, and any pre-existing medical conditions that may impact accommodation, dietary or travel requirements, or that may affect the group and/or your ability to complete your travel arrangements. Your trip cannot be undertaken without the provision of these details and direct contact with Her Luxe Travel. Failure to comply will result in the cancellation of your booking at your cost.

Errors and Omissions

Although Her Luxe Travel has made a concerted attempt to verify the accuracy of statements made herein, Her Luxe Travel cannot be held responsible for any error, omission, or unintentional misrepresentation that may appear on the website, or any advertising material originated by the Company.

Third-party Operators and companies contracted to

Her Luxe Travel may offer services of other operators who are not connected with Her Luxe Travel and whose operations are outside the control of Her Luxe Travel. We do our best to recommend operators who we consider to be reliable and offer a consistent level of service. However, Her Luxe Travel accepts no responsibility or liability for the service provided by those operators except as required by law.

Everyone participating in any tours/retreats where the destination includes part of the Department of Conservation Estate (New Zealand) Government-run operation or a National Park in any of the countries we operate in are subject to any regulations and procedures in place to protect and preserve the flora or fauna of that location.

Our group trips/retreats may be run by local tour guides. The decision of the tour guide at the time is final on all matters likely to affect the safety or well-being of any traveller or staff member participating in the trip. If you fail to comply with a decision made by a tour guide or interfere with the well-being or mobility of the group, the tour guide may direct you to leave the trip immediately, with no right of refund.

Her Luxe Travel may also elect not to carry you on any future trips booked. You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited, be respectful of locals and your fellow guests and you also agree to travel in accordance with our responsible travel guidelines.

A: Release of liability, waiver of claims, and indemnity agreement

In consideration of Her Luxe Travel allowing me to participate in any tour or retreat and any related activities I agree:

In the event that I, or my next of kin, suffer any loss, damage, expense, or injury from my participation in the activities including those caused by the risks specifically outlined in this waiver, I agree to waive any and all claims I have or may have in the future against Her Luxe Travel and to Her Luxe Travel from any and all liability.

To hold harmless and indemnify Her Luxe Travel from any and all liability for damage to property or personal injury to any third party resulting from my participation in the Event.

This contract is governed by the laws of New Zealand, and any legal action arising therefrom shall be litigated only in the appropriate court having authority in New Zealand. Any litigation involving the parties to this Agreement shall be brought solely within the Country of New Zealand and shall be within the exclusive authority of the Courts of New Zealand. This Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns, and representatives, in the event of my death or incapacity.

This Agreement and any rights, duties, and obligations as between the parties to this agreement shall be governed by and interpreted solely in accordance with the laws of New Zealand and no other authority.

I accept Her Luxe Travel is not responsible for, nor will I attempt to hold liability for any injury, damage, or loss I may suffer on account of conditions, actions, or omissions that are beyond my own control. I agree this waiver includes any third-party activities.

B: COVID Info (if required at time of booking)

All guests’ health and safety is of utmost importance, and we comply with all New Zealand government regulations and those of the countries we travel to. *Update 01/01/2024. We will continually review this status.

For international retreats or tours, requirements for visas and entry must be complied with to attend. This includes Bali and Rarotonga. Please check entry requirements before travel or booking.

In consideration of my participation in the foregoing, the undersigned acknowledge and agree to the following:

· I am aware of the existence of the risk on my physical appearance to the venue and my participation in the activity of the Organization that may cause injury or illness such as, but not limited to Influenza, MRSA, or COVID-19 that may lead to paralysis or death.

· I have not experienced symptoms of fever, fatigue, difficulty in breathing, or dry cough or exhibiting any other symptoms relating to COVID-19 or any communicable disease within the last 10 days.

· I have not, nor any member(s) of my household, travelled by sea or by air, internationally within the past 20 days.

· I did not, nor any member of my household, visit any area within the United States or another country that was reported to be highly affected by COVID-19, in the last 20 days.

· I have not been, nor any member(s) of my household, diagnosed to be infected of COVID-19 virus within the last 10 days.

Following the pronouncements above I hereby declare the following:

· I am fully and personally responsible for my own safety and actions while and during my participation and I recognise that I may, in any case, be at risk of contracting COVID-19.

· That I have been truthful in my responses and understand I will answer voluntarily if required that I have been vaccinated or have had a recent negative covid test.

· With full knowledge of the risks involved, I hereby release, waive, discharge Her Luxe Travel, its board, officers, independent contractors, affiliates, employees, representatives, successors, and assigns from any and all liabilities, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, injury, or death, that may be sustained by me related to COVID-19 while participating in any activity while in, on, or around the premises or while using the facilities that may lead to unintentional exposure or harm due to COVID-19.

· I agree to indemnify, defend, and hold harmless Her Luxe Travel from and against any and all costs, expenses, damages, lawsuits, and/or liabilities or claims arising whether directly or indirectly from or related to any and all claims made by or against any of the released party due to injury, loss, or death from or related to COVID-19.

C: Optional Activities

In certain destinations, Her Luxe Travel may offer travellers the option to sign-up for optional extra activities or accommodation. If you opt-in for an optional activity or accommodation while on the retreat/tour, it will be included in your package whether you use it or not. Cancellations of optional activities/accommodation may result in a full or partial refund depending on the item booked. Please ask what your refund options are before cancelling an optional activity or accommodation.

During free time in the itinerary, you are welcome to find your own optional activities* outside of those provided by Her Luxe Travel at your own expense.

You accept that any assistance given by your tour guide in arranging optional activities does not render Her Luxe Travel liable for them in any way. The contract for the provision of that activity will be between you and the activity provider.

*Optional activities not included in the trip price and do not form part of the inclusions in the tour package are paid by the travellers directly to external tour operators and assume all risks associated with their booking.

D: Privacy Policy

Any personal information that we collect about you may be used for any purpose associated with the operation of a trip or to send you marketing material in relation to our events and special offers. The information may be disclosed to our agents, service providers or other suppliers to enable us to operate the trip.  We will never sell your information or use it for non-Her Luxe Travel-related purposes.

E: Force Majeure

Her Luxe Travel assumes no liability for any loss, damage, delay, or cancellation resulting in whole or in part from an Act of God or any other force majeure condition, including, without limitation: fire, volcanic eruption, hurricane, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, and any other acts of a similar nature, sabotage, arrests, strikes or labour disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, epidemics, pandemics, or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or the travel supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by Her Luxe Travel that impacts negatively on, or hampers, its ability to fulfil any of its contractual conditions. In the circumstances amounting to force majeure, we will not be required to refund any money to you, although if we can recover any monies from our suppliers, we will refund these to you without any charge by Her Luxe Travel.

F: Acceptance Of Risk

You acknowledge that the nature of the trip is sometimes adventurous, and participation involves a degree of personal and inherent risk. You may be visiting places where the political, cultural and geographical attributes present dangers and physical challenges greater than those present in our daily lives. Inherent risks include, but are not limited to, risk of injury or death from: motor vehicles collisions, animals, roadway hazards, slips, and falls, criminal or terrorist acts, government actions, consumption of alcoholic beverages, tainted food, or non-potable water; exposure to the elements, including heat, cold, sun, water, and wind; your own negligence and/or the negligence of others, including tour guides, other travellers, Her Luxe Travel and its employees, agents and/or representatives; attack by or encounter with insects, reptiles, and/or animals; accidents or illness occurring in remote places where there are no available medical services; fatigue, chill, overheating, and/or dizziness; known or unknown medical conditions, physical excursion for which you are not prepared or other such accidents; the negligence or lack of adequate training of any third-party providers who seek to assist with medical or other help either before or after injuries have occurred; accident or illness without access to means of rapid evacuation or availability of medical supplies or services; and the adequacy of medical attention once provided.

The traveller understands the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness, or death.  In order to partake of the enjoyment and excitement of this trip, the traveller is willing to accept the risks and uncertainty involved as being an integral part of travel, including the risk of infection, illness and death. The traveler hereby accepts and assumes full responsibility for any and all risks and agrees to and shall hold harmless and fully release Her Luxe Travel from any and all claims associated with the trip, including any claims of third-party negligence and/or the negligence of Her Luxe Travel and traveller hereby covenant not to sue Her Luxe Travel for any such claims or join any lawsuit or action that is suing Her Luxe Travel. This agreement also binds your heirs, legal representatives, and assigns. The terms of this HOLD HARMLESS AND RELEASE OF ALL LIABILITY paragraphs, shall survive any termination or cancellation of this Contract, whether by operation of law or otherwise.

G: Limitation Of Liability

Her Luxe Travel, and its employees, members, agents, and representatives use third-party suppliers to arrange tours, transportation, sightseeing, lodging, and all other services related to the trips. Her Luxe Travel is an independent contractor and is not an employee, agent, or representative of any of these suppliers.

Her Luxe Travel does not own, manage, operate, supervise, or control any transportation, vehicle, airplane, hotel or restaurant, or any other entity that supplies services related to your trip. All suppliers are independent contractors and are not agents or employees or representatives of Her Luxe Travel. All tickets, receipts, coupons, and vouchers are issued subject to the terms and conditions specified by each supplier, and by accepting the coupons, vouchers, and tickets, or utilising the services, all travellers agree that neither Her Luxe Travel, nor its employees, agents, or representatives are or may be liable for any loss, injury, or damage to any tour traveller or their belongings, or otherwise, in connection with any service supplied or not supplied resulting directly or indirectly from any occurrence beyond the control of Her Luxe Travel.

To the fullest extent permitted by law you release us and our officers, employees, agents and representatives from any liability and expressly waive any claims you may have against us arising out of or in connection with your participation in a trip, any liability for any loss, death, injury or damage which you may suffer (directly or indirectly) in connection with or arising out of your participation in a trip, and any condition or warranty which would otherwise be implied by law into these Booking Conditions (Implied Warranty), is excluded.

To the extent an Implied Warranty cannot be excluded, our liability in respect of the Implied Warranty is limited to (in our absolute discretion): (i) the provision of a similar trip to an equivalent value; or (ii) a refund of the total amount received by us from you in connection with your booking.

Any claim by you is excluded to the extent that it is for indirect or consequential loss, loss of profits or economic loss, however it arises, or for indirect, special, punitive, or exemplary damages.

Her Luxe Travel assumes no responsibility or liability for any delay, change in schedule, loss, injury or damage or loss of any traveller that may result from any act or omission on the part of others; Her Luxe Travel assumes no responsibility or liability for personal property.

Limitation of Remedies: The Customer agrees that the sole remedy for any default by Her Luxe Travel arising under this agreement shall be the return of the paid Trip Cost. To the maximum extent permitted under applicable law, Her Luxe Travel will not be liable for any indirect, special, incidental, or consequential damages of any kind (including personal injury) regardless of the form of action whether in contract, tort (including negligence) or otherwise, even if Her Luxe Travel has been advised of the possibility of such damages, and the Customer expressly waives any right it may have to recover such damages.

H: Severability

The Customer understands and agrees that if one or more of the provisions of this agreement, for any reason, is held to be invalid or unenforceable, the provision has never been contained herein, therefore allowing all remaining Terms and Conditions to survive and continue as binding.

I: Local Conditions

The Customer is solely responsible for acquainting herself with the customs, weather conditions, physical challenges, and laws in effect at each stop along the itinerary and is encouraged to locate or make contact prior to embarkation with her local embassy or consulate in each destination.

J: Changes to these Terms and Conditions

These Terms & Conditions are subject to change. Your continued use of our services implies your consent to any updates. By booking with Her Luxe Travel, you acknowledge and agree to these Terms & Conditions in their entirety. Her Luxe Travel reserves the right, in our sole discretion, to change these Terms and Conditions at any time. Upon making material changes, we will notify you via the email address you provide to us at booking. The current terms will apply to your booking. You must therefore be familiar with the terms in effect at the time you book.  Your continued use of our services including continuing to use or maintain any bookings after notice of any changes to the terms and conditions constitutes your consent to the changes.
